According to the data of the case, the teacher applied to the court a year ago with a request to recognize that A. Ramanauskas humiliated her honor and dignity by calling her a “Russo-fascist” and “cotton” in the posts published in April 2022 and last March.
The court, having evaluated all the circumstances of the case, found that the text published by the defendant is the assessment and conclusions of the plaintiff’s previous public and private comments in the context of the Russian war against Ukraine, and can be considered the opinion of A. Ramanauskas.
“The defendant’s statements about the plaintiff are expressed in descriptive, commentary words and statements, but they do not contain information about a specific event and specific actions, the existence and correctness of which could be verified,” the court points out.
According to him, the mere fact that the specific disputed phrases contain more positive than deliberative information does not allow the conclusion that the content of the disputed records is a message, and not a subjective assessment, perception and presentation of certain data.
Ž. Bortkevič also asserted that A. Ramanauskas’s statements formed a negative public attitude towards representatives of the Russian nationality.
“Although during the court proceedings, the plaintiff repeatedly stated both in the procedural documents and during the explanations that the defendant’s records incite national discord, are discriminatory due to the plaintiff’s nationality, are directed against persons of Russian nationality, but, after evaluating the entirety of the written material in the case, such a conclusion cannot be reached basis”, the court stated.
The Russian language teacher is also obliged to compensate A. Ramanauskas 4,961 euros in litigation costs.
