It has been proven that IM, being responsible for the upbringing and development of her young daughter, with the obligation to create conditions for her full and harmonious development, to ensure children’s rights, to create suitable conditions for the child to live and grow, abused her rights and duties as a mother and systematically crushed her physically and mentally his young daughter, treating her cruelly.

It was established that from 2018 in June until 2022 in November IM systematically physically and psychologically harmed the victim and treated her cruelly – beating, strangling, intimidating, belittling, emotionally neglecting, humiliating her with words and actions, forbidding her to eat or demanding to pay for food. It was established that the victim was diagnosed with a mild health disorder as a result of such criminal acts.

IM fully admitted her guilt for committing the criminal acts charged against her and explained that everything was essentially as stated in the indictment, but she pleaded that most things were exaggerated by her daughter out of anger. According to IM’s testimony, the relationship with her daughter used to be good until they provoked each other. IM also claimed in court that such behavior could have been caused by improperly selected parenting methods.

However, the data collected in the case allowed the court to conclude that IM’s illegal actions were caused by excessive alcohol consumption, and not by an attempt to properly educate or raise his daughter. Judge Vita Padriezaitė’s verdict stated that: “In the case under consideration, it was established that the health of the minor victim was easily disturbed due to the intentional actions of IM.” In addition, the improper care of the child was not a one-time event, the girl was systematically physically and psychologically oppressed, as a result of which she experienced painful spiritual experiences. The court also appreciates the fact that at the beginning of the crimes specified in the indictment, the victim was a minor and could not defend herself against an adult with whom she should feel safe.”

in 2024 May 7 In the judgment of the Kaunas Chamber of the Kaunas District Court, IM was found guilty of abuse of parental rights or duties (Article 163 of the Criminal Code) and minor health impairment (Article 138 of the Civil Code, Paragraph 2, Paragraph 1, Paragraph 3).

After summarizing the sentences, she was sentenced to 8 months of imprisonment, with its execution suspended for a period of 2 years. During the execution of the sentence, the IM is obliged not to leave the house at the specified time, if it is not related to work or study, not to leave the city limits of the place of residence without the permission of the institution supervising the convict, to work or register with the Employment Service, and not to use psychoactive substances. The convict is also obliged to participate in programs that change violent behavior within 4 months. In the case, the victim’s civil claim for non-pecuniary damages was partially satisfied.
