The deportation procedure is suspended until the court makes a final and unappealable decision, the LVAT decided on Wednesday.

The LVAT panel of judges announced that it did not determine that in this particular case the applicant is asked to apply the means of securing the claim is inadequate, its application violates the principle of proportionality, the balance of the interests of the parties to the process, and the public interest.

The applicant also based his request to apply a claim security measure on the fact that his mother is a citizen of Lithuania, and she needs constant help due to her health condition. V. Vodo lives with her mother, who has no other relatives and is completely dependent on her son.

On February 7, the Regional Administrative Court accepted V. Vod’s complaint, but did not agree to stop the deportation from Lithuania.

This court, evaluating the applicant’s arguments, concluded that in this situation there is no reason to claim that, if the measures to secure the claim requested by the applicant are not applied, there may be serious damage that is difficult to repair. According to the court, V. Vod’s arguments regarding possible damage are declarative, abstract, based on hypothetical considerations, subjective assessment, not supported by any objective evidence.

The court stated that the applicant did not provide data that he was taking care of his mother, that he was assigned to take care of a family member.

The Regional Administrative Court drew attention to the fact that the implementation of the decision of the Migration Department on December 12 last year cannot be suspended.

The court came to the conclusion that at this stage of the proceedings, there is no basis for applying the security measure requested by the applicant.

V. Vodo, who is now 62 years old, has been living in Lithuania since 1989 (35 years), since 1998. November 1 he worked intermittently in Lithuania, his first permanent residence permit in Lithuania was issued to him in 1993, the last permanent residence permit in Lithuania was valid until 2027. ELTA reminds that on March 20, the Vilnius Chamber of the Administrative Court of Regions upheld the decision of the Migration Department, which revoked the residence permit in Lithuania and decided to deport Lithuanian citizen V. Vodo from Lithuania to Russia. The State Security Department (VSD) has concluded that this person poses a threat to the security of Lithuania.

The court concluded that the Migration Department detailed, comprehensively and clearly stated the significant factual circumstances in the decision, specified the specific applicable legal norms and reasonably applied them in the applicant’s case. Both the legal and factual reasons for the decision are clear.

The lower court found that the Migration Department correctly applied the legal norms, thoroughly examined the factual circumstances, and the decision is legal and justified.

The Russian citizen said that the defendant did not take into account family circumstances, his age, long economic ties. V. Vodo claims that he is connected to Lithuania through particularly close family and social ties, since 1989. worked as a journalist in Lithuania, speaks Lithuanian perfectly, completely cut off all ties with the country of origin.

The Migration Department is participating as a defendant in this case, the VSD is included as a third interested party.

A Russian citizen’s residence permit in Lithuania was revoked after the VSD concluded that this person poses a threat to the country’s security.

According to the VSD’s assessment, according to the available information and taking into account the geopolitical situation today, the life of Russian citizen V. Vod in Lithuania poses a threat to state security.

The VSD believes that V. Vodo, who presents himself as a journalist, has views disloyal to Lithuania, and spreads propaganda information in social networks in line with Russia’s information policy.
