According to the file, on the morning of April 30, 2021, the head of the Oro navigacijos division at that time secretly left the recorder turned on in the office of the head of the temporary company. Knowing that a closed meeting of the company’s board would be held on that day, which could not be recorded by making audio recordings, the head of the unit illegally collected confidential information about the activities of the company important for ensuring national security and expected changes in the structure. An illegally left pen-type recorder was discovered in the evening of the same day.
In November 2022, the district court of the city of Vilnius acquitted the head of the company’s department as having not committed an act that had the characteristics of a crime or misdemeanor.
Disagreeing with such a court verdict, the prosecutor of the Vilnius District Prosecutor’s Office, who led the pre-trial investigation and supported the state prosecution in the case, filed an appeal, requesting a guilty verdict and a fine of 10,000 for this criminal act. euro fine.
At the beginning of May last year, after the Vilnius District Court rejected the prosecutor’s appeal, a cassation appeal was submitted to the Supreme Court. In February of this year, the Supreme Court of Lithuania (LAT) satisfied the cassation appeal and sent the case back for appeal.
The panel of judges of the Vilnius District Court, which examined the case on appeal, took into account the arguments set out in the prosecutor’s complaint that the head of the unit illegally installed the dictaphone – he did not bring the dictaphone to a specific interview, but secretly left it turned on in the temporary manager’s office for the whole day, realizing that confidential information could be recorded information. The head of the department also entered the manager’s office illegally, giving a false reason to the security guard.
The court stated that the head of the division of the state company “Oro navigacija” committed a criminal act and imposed the fine requested by the prosecutor.
