1. Duty of construction contractors to notify subcontractors IS “Infostatyba”

Contractors hired by the builder, about whom the builder notifies IS “Infostatyba” in accordance with the procedure established by the Law on Construction together with a notice about the start of construction, the hiring or appointment of the contractor and the managers of the main construction areas (Notice), after the registration of this notice, must provide data on the subcontractors they hire. The possibility to specify subcontractors has been realized for all the contractor’s employees who have the authority to work on the Territorial Planning and Construction “Gate” portal www.planuojustatau.lt and only for messages with the status “Accepted”. Subcontractors can be indicated by opening a message through the “Fixing subcontractors hired in construction” area, which can be found in the “My construction” environment.

2. In accordance with the requirements of legal acts, additional documents are submitted

When registering structural project (part thereof) or structural (part thereof) expertise documents, a document must be uploaded to IS “Infostatyba”, confirming that the expertise contractor is insured with compulsory civil liability insurance.

When applying for a construction permit document (SLD) for the construction of a farmer’s homestead in accordance with the provisions of the Farmer’s Farm Law, a certificate of income from agricultural activities will have to be submitted with the application for the issuance of the SLD.

During construction completion procedures (approving declarations about construction completion or issuing construction completion acts), an updated cadastral data file of the plot of land on which the structure was built or reconstructed will have to be submitted, in accordance with the procedure established in the Real Estate Cadastre Regulations.

3. The right of the Construction Inspectorate to suspend the certificates of construction participants

After the State Spatial Planning and Construction Inspectorate under the Ministry of the Environment (Construction Inspectorate) imposes administrative responsibility (fine) on a construction participant, the construction state supervision officer will suspend the validity of his certificate pending the decision of the certifying organization, if the same person repeatedly commits a violation within 5 years. The deadline for the first of the violations, which will lead to the suspension of certificates, will be counted from 05/01/2024.

4. Changes in verification of construction completion documents

Amendments to the Law on State Supervision of Territorial Planning, Construction and Land Use provide that after the Construction Inspectorate checks the certificates on the construction of the structure without deviations from the essential project solutions, declarations on the completion of construction, the legality of acts of completion of construction and if violations are detected, under the conditions established by the law, construction participants will be able to remove or sign a settlement agreement with the Construction Inspectorate regarding the elimination of violations before the start of a legal dispute regarding the cancellation of the relevant document. This is expected to reduce the number of legal proceedings, to encourage individuals to eliminate violations without destroying documents.

About the fact that an inspection report was drawn up, which states that the certificate about the construction of the building without deviations from the essential decisions of the building design, the declaration about the completion of the construction or the completion act was drawn up illegally, the Building Inspectorate will inform the Center of Registers of Enterprises about making an entry in the Real Estate Register, submitting the corresponding inspection report act.

5. The construction inspection will no longer supervise the use of easements

Amendments to the Law on State Supervision of Territorial Planning, Construction and Land Use provide that the Construction Inspectorate will no longer check compliance with the land easements established for the inspected object from 01.05.2024.
