As the prosecutor’s office announced on Thursday, the pre-trial investigation was started in the fall of 2021. Martynas Radinas, the then chief patrolman of the Panevėžys AVPK police, who came to the call in the Panevėžys district, used physical violence against the owner of the house who called the police, without having a factual and legal basis.

The representative asked to increase the non-pecuniary damage compensation awarded to the victim to 30 thousand. euros.

It was established that at first the officer knocked this person from the chair to the ground and put handcuffs on him, and then pushed the detainee who was being led out of the house. A man who was behind with his hands tied fell and injured his face.

The police patrol was charged with abuse of office and minor health impairment.

Last year in May, the Panevėžys District Court, which examined the case, acquitted M. Radina of not having committed these criminal acts.

After appeals by the prosecutor’s office and the victim’s lawyer, the Panevėžys district court found the patrolman guilty in September of last year. In summary, he was sentenced to a 6-month prison sentence, with an obligation to participate in a violent behavior correctional program while serving the sentence.

Along with the sentence, the accused was given a measure of criminal impact – deprivation of the right to work as a police officer for three years and a payment of 500 euros to the Fund for Victims of Crime, and was also ordered to compensate the victim 3 thousand. EUR non-pecuniary damage.

This sentence was appealed by the representatives of the accused and the victim and the Panevėžys district prosecutor’s office in the Supreme Court of Lithuania. Mr. Radin’s representative requested that his client be acquitted.

The representative of the victim asked to increase the non-pecuniary damage compensation awarded to the victim to 30 thousand. euros. The prosecutor’s office asked to award non-pecuniary damages directly from the convicted M. Radin, and not from the state.

After examining the cassation appeals, the Supreme Court of Lithuania on April 24 made a decision to reject all of them and upheld the conviction against Mr. Radin.
